As part of the Clean Water Act of 1972, the NPDES permit program was created to address water pollution by regulating how and where pollutants are discharged to the waters of the U.S. As such, before companies can discharge pollutants, such as those found in stormwater or wastewater, into U.S. waters (or waters of the state), they must obtain the appropriate NPDES permits.
Here’s where it gets complicated: The NPDES permit contains strict regulations that are specific to each individual facility, such as limits on what a facility can discharge, requirements for monitoring and reporting, and other provisions—all designed to ensure the discharge doesn’t impact water quality or pose a health risk to the general population. Put another way, the NPDES permit translates the general requirements of the Clean Water Act into specific provisions tailored to the operations of each facility discharging pollutants. No two facilities will have the same requirements, which means there is no canned process for handling these needs – and it can be complex and cumbersome to navigate.
